Welcome to PeakFrame. These Terms of Service ("Terms") govern your use of the PeakFrame website (thepeakframe.com), the PeakFrame mobile app, and the PeakFrame smart display device (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.

About PeakFrame

The Service is operated by PeakFrame Inc., a corporation incorporated in Nova Scotia, Canada. References to "we," "us," and "our" mean PeakFrame Inc.

Eligibility

You must be at least 13 years old to use PeakFrame. If you are under 18, you may use the Service only with the involvement and consent of a parent or guardian.

Your Account

To use most features, you need to create an account. You agree to:

  • Provide accurate and complete information
  • Keep your password secure
  • Notify us immediately of any unauthorized access
  • Take responsibility for all activity under your account

You may delete your account at any time through the app settings or by contacting us.

Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Upload content that is hateful, harassing, sexually explicit, or violates anyone's rights
  • Attempt to reverse engineer, hack, or disrupt the Service
  • Use the Service to harm or harass others
  • Resell or commercially exploit the Service without our written permission

We reserve the right to suspend or terminate accounts that violate these Terms.

Your Content

You retain ownership of the photos and content you upload to PeakFrame. By uploading content, you grant us a limited license to store, display, and process your content solely for the purpose of providing the Service to you. We will never use your photos for marketing, training AI models, or any purpose beyond delivering the Service to you, without your explicit consent.

Purchases

Pricing. All prices are listed in Canadian dollars (CAD) unless otherwise noted. We reserve the right to change prices at any time. The price you pay is the price displayed at checkout.

Payment. Payments are processed by Shopify Payments. By purchasing, you authorize us to charge your payment method for the total amount of your order.

Order acceptance. Your order is an offer to buy. We reserve the right to accept or reject any order. If we cancel your order, we will refund any payment in full.

Shipping. Shipping is free across Canada. Estimated delivery times are provided as guidance only and are not guaranteed. See our Shipping Policy for details.

Warranty

PeakFrame devices come with a one-year limited hardware warranty against manufacturing defects. The warranty does not cover damage from misuse, accidents, unauthorized modifications, or normal wear and tear.

Service Availability

We strive to keep PeakFrame available 24/7 but we cannot guarantee uninterrupted service. We may need to suspend the Service for maintenance, updates, or reasons beyond our control. We are not liable for any downtime.

Software Updates

We may release updates to the PeakFrame app and device firmware to add features, fix bugs, or improve security. You agree to install reasonable updates necessary for the Service to function properly.

Limitation of Liability

To the maximum extent permitted by law, PeakFrame Inc. is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid for your PeakFrame device in the 12 months preceding the claim.

PeakFrame is a tool for tracking habits. We make no medical, psychological, or therapeutic claims. PeakFrame is not a substitute for professional advice.

Indemnification

You agree to indemnify and hold PeakFrame Inc. harmless from any claims arising from your violation of these Terms or your misuse of the Service.

Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service at any time by deleting your account.

Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the app. Continued use after changes means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Nova Scotia.
